Terms of service
These terms cover your use of eternitysquaredtech.com and the website services offered by Eternity Squared Technologies LLC ("Eternity Squared", "we", "us"). By using the site or hiring us, you agree to them. Each project may also have its own written proposal, and where the two differ, the proposal controls.
The free demo
The homepage demo and competitor report are free and come with no obligation. We keep the rights to demo designs until you pay for them. You may not publish or reuse a demo without our written permission.
Services and plans
- Monthly plans have nothing due up front and a 12-month minimum, then continue month to month. You can cancel after the minimum with 30 days' notice.
- Pay-once plans are paid in full as agreed in the proposal. They include 3 months of updates and hosting, then $49 a month unless you host the site yourself.
- Advanced projects are quoted individually. Third-party costs such as hosting and databases are billed at cost.
Prices on the site are in US dollars and may change for new clients. Prices in your signed proposal stay the same for that project.
Payment
Invoices are due on the date shown. Late payments may pause hosting, updates and support until the account is current. We may suspend a live site that stays unpaid for more than 30 days.
What we need from you
You agree to give us accurate information, text, photos and logos in a timely way, and to confirm you have the right to use them. Delays on your side can move the launch date.
Ownership
- Your domain, content, logo and brand always belong to you.
- On a pay-once plan, the finished site belongs to you once paid in full.
- On a monthly plan, we own the site while the plan is active, and you may buy it out after 12 months.
- We may use tools, code and templates we created before or during your project in other work.
- With your permission, we may show the finished site in our portfolio.
Third-party services
Your site may rely on services we do not control, such as Google, payment processors and domain registrars. We are not responsible for outages, price changes or policy changes by those providers.
No guarantee of results
We do our best to build a fast, accurate site and to follow good search practices. We cannot promise a particular search ranking, number of visitors or amount of sales, because those depend on search engines and other factors outside our control.
Limits on liability
To the extent the law allows, our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, lost data or indirect damages.
Website use
Do not use this site to send spam, attempt to break into it, or submit unlawful content. We may block anyone who does.
Ending the relationship
Either of us may end a project for serious unresolved breach after written notice and 14 days to fix it. If you end a pay-once project early, work already done is billed. On leaving, we will hand over your domain, content and, where you own the site, its files.
Governing law
These terms are governed by the laws of the State of New York. Disputes will be handled in the courts located in Erie County, New York.
Changes
We may update these terms. The version posted here applies to new use of the site, and signed proposals are not changed without your agreement.
